服務條款 / Terms of Service
本法律文件的正式繁體中文翻譯尚未完成。在專業法律翻譯完成前,以下顯示英文原文(正本)。
1. What Waholi is
Waholi ("Waholi", "we", "us") is a bilingual job-advertising board operated by benstaydev for working-holiday-visa holders and employers in Japan. Employers post job advertisements; job seekers browse, filter, save, and apply to those advertisements. Waholi provides the advertising platform and the means to submit applications — and nothing more.
Waholi is a recruitment-information provision service (募集情報等提供事業). It is not an employment-placement, recruitment, introduction, or matching service (職業紹介事業). Waholi does not introduce, screen, rank, score, shortlist, recommend, or select candidates for any employer, does not act as an agent for either party, and never charges a fee contingent on a hire.
2. We do not verify — verify independently
Waholi does not verify the identity, legitimacy, qualifications, solvency, or legal or visa status of any employer or job seeker, and does not verify the accuracy of any job advertisement. Listings, company information, wages, working conditions, and applicant information are provided by users, not by us. A listing being visible on Waholi is not an endorsement, recommendation, or guarantee of any kind.
We do review listings against our content policy and remove ones that break the rules. This is content moderation, not identity verification — the distinction is deliberate. Wherever a review signal appears, it means "content policy reviewed, not identity-verified."
You must verify the other party independently before sharing personal documents, paying any money, signing anything, or starting work. See our scam-awareness guidance. A legitimate employer — and Waholi — will never ask a seeker to pay to apply, pay a deposit, or pay any fee to get a job.
3. No employment relationship; no placement
Any employment, hiring, interview, offer, contract, or working relationship is solely between the employer and the job seeker. Waholi is not a party to it, is not the employer or agent of either party, and is not responsible for it. We do not introduce candidates, do not participate in selection or negotiation, and do not earn any placement or success fee. Communication and hiring happen off-platform; Waholi does not act as an intermediary in those dealings.
4. Eligibility and accounts
- You must be at least 18 years old to use Waholi. The service is intended for working-holiday-visa holders and employers; working-holiday visas are issued only to adults, and Waholi is not intended for, and does not knowingly collect data from, minors.
- You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account.
- One role per account (seeker or employer) at sign-up. You must provide a valid email and verify it before applying (seekers) or publishing a listing (employers).
- We may suspend or close accounts that violate these Terms, our content policy, or applicable law, or that we reasonably believe are fraudulent or harmful.
5. Seekers
- Provide truthful profile information (declared nationality, visa type, Japanese level, bio). Do not impersonate anyone.
- Applying shares your application with that one employer — your message, the declared visa/Japanese-level snapshot, and your declared profile details (display name, nationality, visa type, Japanese level, location preference). You choose when to apply; submitting an application is your consent to that disclosure. See the Privacy Policy for the exact fields.
- Ensure any work you pursue complies with your visa conditions. Working-holiday visa holders may not perform work in adult-entertainment businesses (風俗営業) or other prohibited categories.
- Never pay to apply or to "secure" a position. Report anyone who asks.
6. Employers
- Post only genuine, lawful, accurate job advertisements for real, currently-open positions. Provide the required company details (name, real address, prefecture/city, contact email and phone). Keep listings current; close them when filled.
- Comply with Japanese labour and job-advertising law, including the prohibited-content policy: no adult/風俗 work, no illegal work, no discriminatory wording (age, gender, nationality) beyond what law allows, no false, bait, or misleading listings, and no requests for applicants to pay any fee.
- Application and applicant data you receive through Waholi may be used only to evaluate that application and contact that applicant about it. Handle it in accordance with the 個人情報保護法 (APPI); do not sell it, repurpose it, or transfer it improperly.
- You are responsible for your own hiring decisions and for complying with all laws applicable to you as an employer. Waholi makes no selection on your behalf.
7. Prohibited conduct (all users)
- Posting false, fraudulent, illegal, discriminatory, or visa-violating content.
- Posting adult-entertainment / 風俗 work or any work prohibited on a working-holiday visa.
- Requesting payment from applicants to apply, to "secure" a job, for training, for a visa, or for accommodation before work begins.
- Harvesting, scraping, or bulk-collecting listings, profiles, or contact data; circumventing rate limits; or automated access without permission.
- Impersonation, harassment, malware, phishing, or attempts to compromise the platform or other users.
- Using Waholi to run a placement/introduction (職業紹介) business, or to broker candidates, through the platform.
Any job or user is reportable. Reports enter an admin queue with a 24–48 hour target review window. We may remove listings, and suspend repeat offenders and remove all their listings.
8. Applications and the passive applicant inbox
Applications are shown to employers chronologically only. Waholi never sorts, scores, highlights, filters, suppresses, or delays applications, and provides no "recommended candidates," ranking, or automated screening. Application status labels are set only by the employer (or withdrawn by the seeker); Waholi sets no status automatically. This passive-conduit design is part of keeping Waholi out of 職業紹介 (§1).
9. Fees
Waholi is free for job seekers, always, and seekers are never charged. Posting is free at launch; employer paid features (e.g. featured listings, additional job slots, branding) may be introduced later as clearly-disclosed advertising placement. A featured listing may be shown more prominently in search results (e.g. placed above non-featured listings, with a label) — that is the advertising benefit, and it is disclosed as such. Paid features never affect the applicant inbox: they give no earlier or preferential access to applicants, no candidate ranking, sorting, or selection, and no effect on how or when applications are shown to an employer (the applicant inbox stays chronological and passive, §8). Advertising placement of a listing is permitted; any prioritization of candidates is not.
10. Content you submit
You retain ownership of the content you submit (listings, profiles, messages). You grant Waholi a limited licence to host, display, and transmit it as needed to operate the service (e.g. show a listing publicly, deliver an application to the chosen employer). Your content is stored and shown as plain text, escaped; we do not allow HTML or rich text, and links in text are rendered inert. You are responsible for the content you submit and warrant you have the right to submit it.
11. Disclaimers and limitation of liability
Waholi is provided "as is" and "as available," without warranties of any kind, to the maximum extent permitted by law. We do not warrant that any listing is genuine, lawful, or accurate, that any employer or seeker is who they claim to be, that you will find a job or a candidate, or that the service will be uninterrupted or error-free.
To the maximum extent permitted by applicable law, Waholi and benstaydev are not liable for any loss or damage arising out of: any dealing, agreement, or dispute between an employer and a seeker; reliance on any listing or applicant information; any work performed or not performed; any fraud, scam, or misrepresentation by a user; or any visa, immigration, tax, or labour-law consequence. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited (including liability for intentional misconduct or gross negligence).
12. Privacy
Our handling of personal information is described in the Privacy Policy, which forms part of these Terms.
13. Changes, governing law, and contact
- We may update these Terms; the "last updated" date above reflects the current version. Continued use after a change means you accept the updated Terms.
- These Terms are governed by the laws of Japan, and any dispute is subject to the exclusive jurisdiction of the courts of Japan (the Tokyo District Court as the court of first instance), to the extent permitted by law.
- Contact: support@waholi.jp.
Waholi is a job-advertising platform. We do not verify the identity, legitimacy, or legal/visa status of employers or job seekers — verify independently.
